The federal appeals court decided on this week that it would reexamine the case concerning the executive power with an expanded group of eleven justices. The court also overturned a earlier ruling from a smaller judicial group that had supported the administration.

Ongoing Dispute Over Troop Deployment

This legal directive represents the most recent development in a protracted court case over whether the administration has the authority and justification to send state military units in the city. Approximately 200 federalized guard members have been in limbo since the end of September when the mobilization attempt was started in due to ongoing demonstrations.

Conflicting Arguments

The administration has claimed that federal officials at the immigration center in the southern part of the city were facing threats, while local authorities maintain that municipal police have command of the situation.

Contrary to characterizations of Portland as a conflict zone, residents have been posting videos of lush hiking trails and a vibrant culinary culture, and organizing events such as an protest bicycle event against the increased military presence.

Recent Legal Actions

The Tuesday ruling came after a federal judge in the city enacted two legal injunctions this month – one blocking the federal control of the Oregon national guard, and another prohibiting the deployment of any national guard troops in the state, after attempts to evade the first order by calling up out-of-state forces.

On Monday, the ninth circuit panel had put the first ruling on hold – allowing command of 200 Oregon national guard – but the second ruling remained in place, preventing the actual deployment of the forces.

The latest ruling means the issue will be heard “en banc” – with all decisions under consideration simultaneously – by a panel of eleven justices.

“This decision shows that the truth matters and that the judicial system are working to hold this administration accountable. The constitution restricts the president’s power, and Oregon’s communities cannot be treated as a testing site for unchecked federal authority,” stated the state attorney general in a official comment.
